    Also, please realize that any changes to the bill will meet absolute resistance from both sides. We will have to wait and see how many amendments are they planning on allowing.....

    Ragz to be perfectly honest i know this bill is VERRRRY important to us, but this bill carries Far more problems than relief. Right now there are So many "Ifs" and "Ands" that somehow i dont see it passing or atleast not anytime soon, forget abt passing by memorial day.

    If it actually DOES pass by memorial day, that day actually WILL be Memorial for us legal immigrants :) But one another note. Thanks for posting the link. I know a lot of us are writing the same thing, but that should not deter people from posting info like this on the forum.

    I have lived in Nevada before. I think in that state and many other western states (where guns laws are more liberal) you have to have passport, I-94 and utility bills proving you have lived in NV for 6 months. That's it. You don't need hunting license to get a gun license.

    Here is the biggest irony:

    IN order to own a gun, FBI needs only 2 days to check your background.

    IN order to get 485 approved, FBI takes months or years to do a background check.

    I guess green-card is a more lethal weapon than a handgun.


    There are federal firearm laws and then there are local (state) firearm laws.

    State laws can be more restrictive than federal laws (atleast when it comes to firearms), but never less restrictive.

    Federal law states that non-immigrants (even AOS) are prohibited from owning firearms unless they fall under one of 4 exceptions, the easiest one being the hunting license exception.

    If you have a valid hunting license, issued anywhere in the United States (you could live in NV and have a hunting license from NY) you are okay on the Federal level.

    After you have met that exception, you have to check and see if your state has additional restrictions.

    Some states don't discriminate between citizens/non citizens when it comes to firearms, some do.

    e.g. in MA, non-citizens (even GC holders) are only allowed to own non large capacity rifles and shotguns, which means no handguns, and no large capacity rifles (ARs, AKs and the like).

    Logiclife, yes, there are some cases where a non-immigrant accidentally manages to bypass the hunting license requirement. This can happen in states which issue their own non-citizen permits. The applicant gets the 'non-citizen' permit and thinks that he/she has done their part and is now okay to purchase/possess a firearm. This is somewhat of a loophole that every non-immigrant buyer should be wary of and absolutely avoid. Sometimes the NICS background people can also approve the transaction without realizing the non-immigrant situation, but that doesn't mean its okay, I have confirmed this with the ATF on the phone.

    Getting a hunting license is not difficult though, passing a simple hunter safety course is all that is required.

    That being said, I am very pleased to find responsible and safe firearms enthusiasts on this forum.

    And the person that asked the OP if he was inquiring about firearm laws because he wanted to kill someone, I hope you were joking. If you weren't, your ignorance disgusts me.

Your experience in India and USA will help you learn more. I feel the punishments in US are not harsh enough. If you have a bad habit of shoplifting and you used to do it in India then ignore the answer above and check into a rehab and request them to have you share a room with Winona Ryder.You both have something in common and you will be able to relate to each other very well.

    My friend you have hit upon a very good idea. For compulsive shoplifters a similar incidence would be more than enough to rehab them for rest of the life.     One of my friend asked Shiela Murthy and she said that in order to be able to add my spouse , I would have HAD to get married before July 31st (which I couldn't anyway), because, then, only I/we will be eligible to add my spouse.

    double-check that note from Sheela Murthy (take an appointment with either her, or Rajiv Khanna). You have to get married before your 485 is approved, dont know whats that July 31st date. Good thing you filed your 485 atleast. You can add your spouse only when your PD is current, but you can atleast use AC21 in the meantime (for changing employers etc).

    To summarize the INS position, as long as the principal applicant gets married prior to the INS' approving the I-485 application, there should be no problem for the dependent/s to either file the Adjustment of Status, if in the U.S., or to "follow to join," based upon a consular interview abroad. Therefore, the principal can file the Adjustment of Status application prior to marriage, but the marriage needs to take place before INS makes its decision on the I-485 application.

    i just read on another forum, that about 70,000 visa's come up for the new fiscal year which starts 1st october, so it might take a couple of months to see any movement, but it will happen, as they have got to wait and see and get a better feel for how many filers there were for july/augest, as they havent processed them all yet, then we will see something happen. so lets wait and see what the Nov bullitin says, and if the rally had any kind of effect.

    140K visas come up for the new fiscal, not 70k. Those 140k are somewhat evenly split (20-30% each) across teh four quarters (its not an exact science, but thats the order in which USCIS requests visas from Dept of state). So the number of visa numbers used up in october is going to be much lesser than 70K, probably around 10-12k.

    The backlogs are right now way too extensive to result in any major movement of PD with current quotas. If dates move in November, they are only expected to creep along... I hope I am wrong, but thats what it looks like

    The effect of the Rally is not going to be on the visa bulletin; it is on legislators who need to now come up with some way to ease these huge waits (either recapture visa numbers or bump up the annual cap or both). unless congress wakes up to this and does something, we are in for a long wait.

    Hi Ragz4u,

    This is THE time to stop answering negative mails,and convincing chronic doubters. It definitely distracts. Maybe until the bills gets to voting on the Senate floor, we should all unilaterally stop spilling out our doubts and apprehensions on to the forum. Any serious chronic and obsessive doubters should write a PM to Ragz4u or any other internal contacts.

    Now, coming to more useful part: Many of the universities and research institutions employ chinese and Indian postdocs and researchers on H1. Many of them sponsor GCs via EB2 and rarely EB1. Although many members here in the forum are under EB3 (isn't it?), the retrogression affects both EB2 AND EB3. The catch is, these institutions come under (many of them if not most) a category called non-profit, no cap etc. Looks like they cannot, as institutions, lobby against retrogression. I personally tried to do this in my institution but I was turned away; also my institution is very small unlike for example: University of California schools, or University of Texas schools. In all these institutions, the affected researchers work for individual Nobel laureates, accomplished professors (both chinese and Indian origin AND native born Americans) who can support the efforts. That requires a nodal point for information exchange. One side, IV can do this and on the other end, there are somethings called: postdoctoral fellow associations in many universities.

    It will make more sense for an organization like IV trying to convince NPA to raise this issue than individuals like me. I have been in science for 14 years and I say from my experience.

    There are two renowned science journals that talk about career issues.

    The journal Science www.sciencemag.org has a portal called NextWave that deals with career issues of scientists. They frequently write about many visa issues but they need to be dealing with a resource to write about retrogression etc.

    Eveybody talks about retaining best talents back in US but there is no support heard from academic communites on this. So instead of answering

    So there is no dearth of talent in south asia or any part of the world when compared to US or west. It's just that there is a difference in harnessing that talent...

    Look at this way...You might like indian classical, but you might not appreciate western opera...That does not mean that western opera is not upto standards, or vice versa...AR Rahman's music is exceptional...no doubt about that...Because of the way movie makers want in India, it is geared towards indian market...It would be suicidal for indian movie makers if they ignore that...

    Moreover, until recently, there was no separation between movies and music...Music is pretty much wedded to movies and vice versa...Whereas in the west, music is a separate entity and an industry of it's own...If you have a separate entity like that, it is easier to put your skills in a variety of ways and therefore easier to showcase your talent and easier for others to spot the talent...

    Also, in India, movie industry is more paternal of nature...Barring few exceptions, irrespective of talent, some actor/musician, etc. get the roles because his/her family is tied to the industry...(Although it's slowly changing now)...Because of this, you might not get the best talent even though it's out there. Ofcourse, in the west also, you might see the same here and there, but IMO, it's more prevalent in indian cinema...

    Lastly, spotting talent greatly depends on the director. In India, we hardly have exceptional directors...Also, I suspect the directors in India are given as much freehand as we hear in the west. If I remember correctly, it was said that it was an accident that AR got the chance in the movies by accident...I think ramgopal (/or maniratnam) (when he was yet to make name for himself) wanted ilayraja to score his movie way back, and was told that he was busy...Stung by it, the director brought AR and from there, the rest was history...

    But nonetheless, better late than never and AR achieved it in a big way by winning two in a night...

    If you want OCI, there are a few hoops to jump through -

    1. Apply for an Indian passport first.

    2. Once the Indian passport is issued, apply for the US passport.

    3. Return the Indian passport after the US passport is issued. The consulate should return the Indian passport back to you, but keep a photocopy in case they don't.

    4. Now you can apply for OCI on the grounds that your son once held an Indian passport.

    Absolutely wrong. Lot of misinformation here. You can very well apply for OCI for your child even if both of you are Indian citizens and the 4 steps mentioned above are just wrong. I would prefer OCI over PIO as mentioned in the other reply too, on PIO your child will have to register with the police station evry six months if stay is longer. OCI is valid forever while PIO is valid for 10 (or 5) years and OCI means you have all the rights but can't fight elections and vote.
